Terms of Service

These terms govern your use of Dolly. A plain-English summary sits above each section; the full text is what governs. If something here surprises you, the summary should have warned you — tell us if it didn't.

1. The agreement

In plain English: By using Dolly you accept these terms.

Dolly ("Dolly", "we", "us") [TODO: legal entity name and jurisdiction] provides an AI image and video generation service at this site and its API. By creating an account or using the service you agree to these terms. If you don't agree, don't use the service.

2. The service

In plain English: You describe things; third-party AI models generate images and video. Models, prices, and availability change over time.

Dolly turns text prompts (optionally with your reference images) into images and video using third-party model providers. Generation is probabilistic: the same prompt can produce different results, and results may not match what you imagined. We may add, remove, or reprice models at any time; the price shown at generation time is what you pay.

3. Your account

In plain English: Keep your login safe, sign up once, don't farm the signup bonus.

You're responsible for activity under your account. One signup bonus per person; we apply per-IP and per-account limits to prevent abuse, and accounts created to farm bonuses may have the bonus withheld. You must be legally able to enter this agreement.

4. Credits and payments

In plain English: Everything is prepaid credits: 1 credit = $0.01 of listed generation price. Buy packs once or get monthly credits with a membership. Credits aren't money.

Generation is paid for in prepaid credits; every model's price is published in dollars and charged in credits (1 credit = $0.01 of listed generation price). Credit packs are one-time purchases; memberships grant credits monthly and renew until canceled. Payments are processed by Paddle as merchant of record — their terms apply to the payment transaction itself.

Credits are a prepaid service balance, not money or property: they're non-transferable, have no cash value, and can't be redeemed for cash except where the law requires otherwise.

5. Refunds

In plain English: Failed generations refund themselves, automatically, every time. Completed generations and credit purchases are final unless the law says otherwise.

If a generation fails or times out, its credits are refunded automatically — this is enforced in code, not by support tickets. A prompt or upload rejected by moderation is never charged.

Completed generations are final: the compute was spent producing your output. Credit purchases and membership fees are non-refundable except where required by law. Canceling a membership stops future billing at the end of the paid period; credits already granted stay in your account per section 6.

6. Credit expiry

In plain English: Today, we do not expire credits. These are the rules we RESERVE the right to apply in the future — always with weeks of email warning first.

While your account is active — you hold an active membership or have generated within the last 12 months — credits never expire. There is no monthly reset.

We reserve the right to expire credits only as follows: (a) after a membership is canceled, remaining credits may expire 90 days after the cancellation date, unless you resubscribe within that window; (b) on accounts with no generation activity for 12 consecutive months, credits may expire, and any generation resets that clock. Before any credits expire under this section we will send notice to your account email at least 30 days, 7 days, and 1 day in advance.

As of the date above, we do not currently enforce any credit expiry. Our not enforcing this section, in whole or in part, for any period is not a waiver of the right to enforce it after notice as described here, and any future enforcement applies prospectively.

7. Acceptable use and content policy

In plain English: No franchise characters or celebrity likenesses, no sexual content involving real people, absolutely nothing sexualizing minors, no hate or violence glorification. Our filters enforce this automatically and rejected attempts are never charged.

You may not use Dolly to create or upload:

Infringing content — recognizable copyrighted characters, franchise properties, or brand assets you don't have rights to. Real-person content — depictions of recognizable public figures, or any sexual, sexualized, or intimate depiction of any real person, famous or not. Ordinary photos of yourself or consenting adults used as references are a core, intended use. Content involving minors — any sexual, suggestive, or exploitative content involving minors, real or generated, is prohibited absolutely; violations end the account and are reported where the law requires. Hateful or violent content — hate symbols, ideology glorification, or instructions for real-world violence.

Prompts and uploads pass automated moderation before any generation runs; rejected attempts are never charged. Repeated rejections throttle the account temporarily; persistent infringement attempts flag the account for review and may lead to suspension or termination under section 12.

8. Your content and generated media

In plain English: Your uploads stay yours. Generated outputs are yours to use; we keep only the rights needed to run the service. AI outputs may not be copyrightable and similar outputs can occur.

You keep all rights to images you upload, and you must have the right to upload them. You grant us the license needed to operate the service: hosting your content, sending it to model providers to run your generations, and running moderation over it.

To the extent we hold any rights in your generated outputs, we assign them to you. You're responsible for how you use outputs. Note that purely AI-generated works may not qualify for copyright protection in some jurisdictions, and models can produce similar outputs for different users.

9. Media retention and deletion

In plain English: Your generations stay until you delete them. Deleting removes the files for real; billing records of the transaction remain. Rejected uploads are never stored at all.

Generated media and reference uploads are stored until you delete them or close your account. Deleting a generation removes its media files from storage; the billing record of the job (what was charged and refunded) is retained as a financial record. Uploads rejected by moderation are never stored — only a content fingerprint and the verdict are logged. On account closure, stored media is deleted within 30 days [TODO: confirm window]; financial and moderation records are retained as required for legal, accounting, and safety purposes.

10. AI disclaimers

In plain English: Outputs are machine-generated: sometimes wrong, sometimes weird. Don't rely on them as facts or professional advice.

Outputs are generated by automated systems and may be inaccurate, distorted, or unsuitable for your purpose. They are not factual claims or professional advice. Provider-side safety systems may additionally block some generations; blocked generations follow the refund rules in section 5.

11. Copyright complaints (DMCA)

In plain English: Rights holder? Send a notice and we'll act on it.

If you believe content on Dolly infringes your copyright, send a notice with the statutory elements (identification of the work, the infringing material's location, your contact details, good-faith statement, accuracy statement, and signature) to [TODO: DMCA agent email]. We respond to valid notices, accept counter-notices, and terminate repeat infringers.

12. Termination

In plain English: You can leave anytime. We can suspend or close accounts that break section 7 — content-policy violations can forfeit remaining credits.

You may stop using Dolly at any time; section 9 covers your media on closure. We may suspend or terminate accounts that violate these terms — for serious or repeated violations of section 7, immediately. Where an account is terminated for cause, remaining credits may be forfeited to the extent permitted by law; in all other cases, contact us about remaining balances.

13. Disclaimers and liability

In plain English: The service is provided as-is; our liability is capped at what you paid us in the last 12 months. [Attorney: this section especially.]

The service is provided "as is" and "as available", without warranties of any kind, express or implied. To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, and our total liability for any claim is limited to the amounts you paid us in the 12 months before the claim arose.
